This message, which willexpire after 7 years, alerts credit grantors to verify the consumer’s identification in case someone isusing their information without their consent.Our records indicate that we previously conducted investigations regarding the disputed information,providing the creditors with copies of the ID Theft Affidavit report that we had received from theconsumer. The creditor verified the accuracy of the accounts. Results of the investigation wereprovided directly to the consumer. If the results of the investigation are questioned, the consumer maywant to contact the source of the information directly. We appreciate that your office took the time to let us know about his experience with our company.In the complaint [redacted] states that Experian has failed to provide him with an updated copy of “verifiable proof” regarding several accounts and one public record item. [redacted] has requested to have the information removed from his credit report. Our research indicates that [redacted] previously contacted Experian to request an investigation regarding several disputed items. We have reinvestigated this information with each data furnisher. Regarding the disputed public record we Contacted the vendor that Collected the information from the public record source, such as a Court or other government office. They responded and we either updated certain data elements, deleted accounts, or the accounts or public record remained as accurate as reported. On May 14, 2008, July O2, 2008, April 21, 2009, April 23, 2009, April 12, 2010, January 22, 2011, April 11, 2011, April 16, 2011 April 27, 2011, January 15, 2016 and October 12, 2016, we sent the result summaries to [redacted] for review.According to the Fair Credit Reporting Act (FCRA), a national Consumer credit reporting agency’s role in the dispute process is to review the accuracy and completeness of any disputed item which may include contacting the data furnisher of the disputed information and informing them of all relevant information regarding the consumer’s dispute. If the issue is not resolved, then the consumer credit reporting agency must offer to include a consumer statement on the personal credit report.When a consumer disputes the accuracy or completeness of information on a personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that Collected the information from a public record source such as a court or other government office. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the item they disputed, and report back within 30 days of the date that we received their request (21 days for Maine residents). the above mentioned consumer’s personal credit report.Judgments, Tax Liens and Bankruptcies are a matter of public record. Although the court where the disputed public records are filed may not report this type of data, a vendor may collect this data directly from the court’s public records and supply that information to Experian. Experian’s method of verification for public records complies with the requirements of the Fair Credit Reporting Act (FCRA).My review of the public record documents on file at the US Bankruptcy Court in [redacted] indicates the item is accurate as it appears on the Experian credit report: a Chapter 7 Bankruptcy filed by the consumer on 05/14/2008 and discharged on 08/29/2008.Additionally, the documents confirm the consumer’s full name (including generation code), last 4 digits of his Social Security number and address at the time of discharge, his current address. Discharged Chapter 7 Bankruptcies remain on the credit report for a period of ten years from the filing date.We are in the process of providing the consumer with copies of the bankruptcy filing and discharge documentation.Because the information was confirmed accurate, we must respectfully decline the consumer’s request to remove the disputed information from the Experian credit report.If the consumer disagrees with the results of the reinvestigations, it is their legal right, under the FCRA, to add a 100-word statement specifying the nature of his dispute. In each instance, the Creditors responded that the accounts were accurately reported. First:  According to the Fair Credit Reporting Act as part of the investigation the credit report agencies has duties and one of their duties they  must notify the creditor of my dispute.  And if the creditor does not response then the credit report agency must delete the item off my credit report immediately.. And the credit report agency has not notify the creditor of my dispute.   I call the Bankruptcy Court to see has anything where sent to them by Experian Credit  Report Agency and that stated: NO.  The second thing when I dispute and items the credit report agency  must put it on my credit report  as a dispute, and they did not put it on my credit report as a dispute.  I have a copy of the duties that the Credit Report Agencies must do under the Fair Credit Reporting Act.  And Experian has violated the Fair Credit Reporting Act.One: They did not Contact the Creditor of my dispute.Two: They did not put  it on my Credit Report as a dispute.I Request that Experian immediately remove/delete  the Bankruptcy off my Credit Report.               Sincerely,  [redacted]

Upon completion of this process, we will provide the results of our investigation directly to the consumer.When a consumer disputes the accuracy or completeness of information on the personal credit report and tells us specifically why they believe the information is inaccurate or incomplete, we process the dispute as required by law. We contact the furnisher of the information or the vendor that collected the information from a public record source such as a court or other government office either electronically or by US Mail. We ask the furnisher or the vendor to conduct a thorough and complete investigation to verify all of the information regarding the disputed item, and report back within the time frame required by law. We review and consider the response to determine whether to accept it, reject it, or follow up for additional information. If, after processing, we find that the disputed information is inaccurate, incomplete or cannot be verified, we then delete that information, or modify that information, as appropriate, based upon the dispute and the results of our processing. If we do not receive a response from the furnisher or the vendor within the required period, we update the item as requested or delete the information. In some instances, upon reviewing the credit file and any relevant information submitted to us, we are able to determine whether the disputed information should be changed or deleted without having to contact the furnisher of the vendor. Investigations can take as long as 30 days to reach a conclusion. After we complete our processing, we send the consumer the results.According to the Fair Credit Reporting Act (FCRA), a national consumer credit reporting agency’s role in the dispute process is to review the accuracy and completeness of any disputed item which may include contacting the furnisher of the information or the vendor that collected the information from a public record source, such as a court or other government office, notifying them of the disputed information and disclosing all relevant information regarding the consumer’s dispute. In order to help resolve the consumer’s dispute, Experian will review all relevant documents submitted by the consumer with the dispute and will forward such documents to the furnisher if Experian is unable to resolve the issue based on those documents. Consumers may also contact creditors directly to dispute items reported by the creditor. If the issue is not resolved, then the consumer credit reporting agency must offer to include a consumer statement on the personal credit report.In addition to the consumer’s right to dispute information in the credit file with the credit reporting agencies, the consumer also has the right to dispute information in the credit report directly with the furnisher of the information. If there is information appearing on a credit report that is believed to be inaccurate or incomplete, we must have a specific dispute. Examples of specific disputes are as follows: “not mine, paid in full, never delinquent or included in bankruptcy” or for public record disputes: “not mine, paid/satisfied, vacated or filed in error”. If the status dates, amounts, balances or other specific data is incorrect, the Consumer should also indicate what the Correct information should be. Please specify the item or account name and number.Please provide the Consumer’s specific disputes along with their Complete identification information (Social Security number, full name, Current address, previous addresses in the last two years and date of birth).
